INEC chairman Mahmood Yakubu served Form 49 by Federal High Court over NRM case

Chairman of the Independent National Electoral Commission (INEC), Mahmood Yakubu, was served with Form 49 by the Federal High Court in Abuja on Tuesday, June 24. The court bailiff, Ayuba Sule, served the form on behalf of the National Rescue Movement (NRM).
This follows the service of Form 48 last week. In Nigerian legal procedure, Form 48 warns an alleged contemnor about the consequences of disobeying a court order. If the contemnor fails to comply within two days, Form 49 is issued, requiring them to explain why they should not be imprisoned for non-compliance.
The Federal High Court had on March 5, 2025, ordered INEC to accept and recognize the results of NRM’s Emergency National Convention held on January 17, 2025.
According to a statement by the NRM spokesperson, Chinedu Anselem, the service of Form 49 means Yakubu now has only a few days to comply or face court proceedings where he must justify his refusal to obey the court order.
The NRM also accused Yakubu of a history of defying court orders and emphasized their commitment to holding public officials accountable under the law.
Responding to questions from DAILY POST, Prof. Yakubu said he is accustomed to being served with Forms 48 and 49 but indicated that the matter is already being resolved through legal channels.
